1.  Definitions and Contract

The Products or Services listed under the heading “Description” on our quote and invoice is sold or provided by Cookie Crumblez to the Customer subject to these terms and conditions. No variation of these terms and conditions is permitted unless expressly accepted by a Cookie Crumblez in writing. Visiting our site including Facebook, Instagram, or website and or purchasing something from us, you engage in our “Terms of Sale” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”, “Terms of Sale”), including those additional terms and conditions and policies referenced herein and/or available by links. These Terms of Sale apply to all users of the site, including without limitation of users who are browsers, vendors, customers, merchants, and or contributors of content.

2.  Order

The minimum order accepted by Cookie Crumblez is 10 Cookies

No order shall be binding on Cookie Crumblez until accepted by Cookie Crumblez. All sales are strictly pre-paid prior to pick up or shipped/delivered unless otherwise agreed upon by Cookie Cumblez, and that you are at least the age of majority in your state or territory of residence. You may not use any of our products or services for any illegal or unauthorized purpose nor, violate any laws in your jurisdiction.

 

3.  Artistic and Creative Freedom

Please understand that we cannot create exact replicas of cookies, each cookie is a unique masterpiece.

We ask that you provide a few pictures of cookies or inspirational pictures you like so that we may get an idea of what you’re looking for i.e., your vision. From there, we will agree on design elements from each photo and build something specific for your event/theme. 

 

When a custom order is placed, an agreement is made that says you are comfortable giving me the artistic freedom required to create your special cookie.

 

4.  Price

All prices discussed via phone, text or any social media platform are mentioned in AUD currency. The price for the Product or Service shall be the price current at the day of release/dispatch and shall include all related delivery costs whether specified or not specified and shall be paid at the time of placing the order unless otherwise agreed to by Cookie Crumblez.

Please note there may be an increase or decrease in price if you change designs. If this occurs, you will be liable for any money owed.

 

5.  Deposit, Cancellation and Refund Policy

Each quote is valid for 48 hours from the date of issue.

Upon the basic design constructs of your cookies being finalised and proceeding with the order, full payment will be required. Your booking is not considered confirmed until the payment has been received. Our method of payment is via direct deposit. Failure to make payments by the due date WILL result in your order being automatically cancelled without warning; please contact me ASAP to discuss any problems/ possible late payment issues. 

 

We are not liable for any damage to the cookies if you do not follow the storage instructions given and no refunds will be given at any point in time.

6.  Method of payment

Cookie Crumblez accepts payment by means of Bank Account either via Internet Banking or by Direct Deposit (please refer to the details on the invoice or quote section for the Cookie Crumblez banking details) or cash. For bank transfers confirmation and funds clearance are required prior to the release/dispatch of any goods.

 

7.  Shipping/Delivery/ Collection

Shipping (Australia post) Once payment is received, we endeavour to send all orders out within 2 – 4* Business days, (Business days being Monday through to Friday.) excluding public holidays. All freight costs and insurance costs are borne by the purchaser. All goods are shipped via Australia Post. No refunds or exchanges will be given in case of late delivery or broken/damaged cookies.

Delivery (available within Metro Melbourne Only) Once payment is received, we will deliver at the mutually agreed upon address and time from Nunawading. If there is no one at the address to accept the cookies we will try to contact, you both by email and phone (and or text message) and if we have not received correspondence back, we will leave them at in an area we deem to look the safest.

Collection: Cookies are to be collected at a mutually agreed upon time from the Nunawading address given. If you have placed an order and I have tried to contact you both by email and phone (and or text message) and have not received correspondence within 24 hours of non-collection, your cookies will be forfeited, and no refunds will be given.

Cookie Crumblez cannot be held responsible for any damage to the cookies once they are delivered, shipped and/or collected and in the care of a client or the venue.  Where a client elects to self-transport, we are not responsible for any damage caused during transportation.

8.  Allergies

Cookie Crumblez will not be held responsible for any allergy related issues. Unless it is specified otherwise on your order, all products may contain or come into contact with dairy, wheat, nuts, soy and other allergens. It is the client’s responsibility to inform their guests of any risks.

9.  Media

Photo Usage: Cookie Crumblez reserves the right to use any photos we take of your creation for media-related activities such as publishing on our website, social media, or advertising.

 

10.  Covid Terms & Conditions:

We retain the right to cancel the booking due to circumstances beyond our control, such as ill-health/family emergency/isolation, during which you will have 3 options to choose from.

1. we will refund any money paid in full.

2. we can move it to another date. Due to the current unpredictability, if your party or event gets cancelled due to restrictions, illness, etc. no refunds will be given. However, any money paid will be put towards a credit for a future order.

3.  If your cookies have already been made and decorated when a new restriction is announced or you inform me that you (or someone close to you) are ill, you will be sent instructions on how to store the cookies long-term.
